This is an interim version of our Terms. A fuller version is being prepared and will replace it. We will notify account holders by email before the new version takes effect.
These Terms of Service (the "Terms") govern your access to and use of cicada.run, including app.cicada.run, the canvassing app, and any related tools and services (together, the "Service"). The Service is operated by Cicada Bot, LLC ("Cicada," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old and able to form a binding contract to hold an account. Volunteers under 18 may use the canvassing app when a campaign invites and supervises them. If you use the Service on behalf of a campaign, committee, organization, or company, you confirm that you have authority to bind it to these Terms, and "you" includes that entity.
We offer the Service to lawful candidates, committees, and organizations regardless of party, ideology, or viewpoint, on the same published prices and terms. We refuse or suspend service only for violations of law, these Terms, carrier or registry requirements, or non-payment, applied without regard to viewpoint. If we suspend your account, we will tell you why, and you may ask us to reconsider.
You are responsible for the accuracy of the information you provide, for keeping your login credentials secure, and for all activity under your account, including activity by team members you invite. Tell us promptly if you believe your account has been accessed without permission.
The Service lets campaigns draw a district or area on a map and find the residential addresses inside it ("Contact Discovery"), optionally add names, phone numbers, and email addresses to those addresses from third-party data providers ("Contact Completion"), organize contacts, build lists, give volunteers a canvassing app, and start calls, texts, and emails from their own devices. We may add, change, or remove features over time.
A campaign's first election is free, which means no subscription and no setup fee. Contact Discovery and Contact Completion consume Contact Credits, and those credits are charged even during a free first election. Plans for later elections, and their prices, are listed on our Pricing page and may change going forward. Unless a plan states otherwise, fees are billed in advance or as used, are due when billed, and are non-refundable except where required by law. You are responsible for any taxes that apply.
The free first election is available to state and local campaigns. Committees registered with the Federal Election Commission pay the published plan price starting with their first election.
Addresses and contact details provided through the Service ("Contact Data") come from public building data and third-party data providers. They do not come from official voter registration files. Contact Data is licensed to you for lawful campaign, civic engagement, and other political purposes permitted by applicable law. You may not resell, sublicense, publish, or share Contact Data outside your campaign or organization, use it for commercial solicitation unrelated to your campaign, use it to harass, threaten, or intimidate anyone, or use it in any way that violates federal, state, or local law. You may not use Contact Data to decide anyone's eligibility for employment, credit, insurance, or housing, including to screen staff or volunteers. If you import your own lists, including voter lists you obtain from election officials, you are responsible for following any conditions that apply to them.
The Service does not place calls or send texts or emails for you. Its outreach tools open your own device's phone dialer, messaging app, or email client, and anything you send goes out from your own phone number or email account. You are solely responsible for that outreach and for complying with all applicable laws, including the Telephone Consumer Protection Act, do-not-call requirements, consent and opt-out requirements, and any rules that apply to political communications. You must honor opt-out requests. We may suspend your access to outreach features if we believe you are using them in violation of these Terms or the law.
You agree not to misuse the Service. That includes attempting to access accounts or data that are not yours, interfering with or disrupting the Service, scraping or bulk-extracting data outside the features we provide, reverse engineering the Service, using the Service to send unlawful, deceptive, or harassing messages, or using it to impersonate another person or campaign.
You keep ownership of the content and data you upload or create in the Service, such as your own lists, notes, and scripts. You give us a limited license to host, process, and display that content as needed to operate and improve the Service for you. You are responsible for having the rights to anything you upload.
The Service, including its software, design, text, and trademarks, belongs to Cicada or its licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose. They do not transfer any ownership to you.
Our Privacy Policy explains how we collect and use information, and it is part of these Terms.
The Service relies on third-party data sources, infrastructure, and providers. We do not control them and are not responsible for their availability or content. Data may be incomplete, out of date, or inaccurate, and we do not guarantee any particular match rate or result.
You may stop using the Service at any time. We may suspend or end your access if you breach these Terms, if required by law, or if your use creates risk for us or others. On termination, your right to use the Service and any Contact Data ends, and you must stop using and delete Contact Data, except as the law requires you to keep it.
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not promise that the Service will be uninterrupted or error-free, and we do not provide legal or compliance advice.
To the fullest extent permitted by law, Cicada will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, votes, or data, arising out of or related to the Service. Our total liability for any claim is limited to the greater of the amount you paid us in the twelve months before the claim arose or $100.
You agree to defend and indemnify Cicada against claims, losses, and expenses, including reasonable attorneys' fees, arising from your use of the Service, your content, your outreach, or your breach of these Terms or applicable law.
These Terms are governed by the laws of the State of Alabama, without regard to conflict of law rules. Any dispute will be brought in the state courts located in Madison County, Alabama, or in the United States District Court for the Northern District of Alabama, and you consent to their jurisdiction. Either party may bring a claim in small claims court if it qualifies.
We may update these Terms from time to time. When we do, we will change the date at the top of this page. If a change is material, we will also notify you at the email address on your account before it takes effect. Updates apply going forward only and do not change the terms that applied to anything that happened before the update. If you do not agree to an update, you may stop using the Service before it takes effect.
